Dangerous Property Manager Contracts – Don’t Sign if it Says These Things

Your relationship with your Property Manager is key to the success of your Commercial Property Investments. This relationship starts with your Contract AND we have found a lot of Property Managers Contracts are heavily weighted in favor of the Property Manager.

These dangerous contracts are often presented as if they are “standard” … Not True. You get what you negotiate. The last thing you want is to be locked into a contract with a poorly performing Property Manager … and no easy way out… OUCH.

Contract Red Flags:

The One Year Contract
The typical version is a Contract with a one full year term and you cannot replace the Property Manager until the year is up.
Never sign a contract with anything more than a 30 day dismissal period.

Termination Fee
Are you kidding. You fire your Property Manager and then you owe them money. Heck, if they performed poorly enough to get fired, they should owe you money.

Lease Signing Bonus paid to the Property Management Company
This is a big conflict of interest. They get paid to do a poor job of Tenant Retention. The higher the turnover, the more fees they make AND the less money you keep.

Right to Represent the Property at the Sale Or First right of refusal to purchase the Property at the Sale
These are an even bigger conflict of interest. If your Property Manager runs the project into the ground and you are forced to sell because the investment failed … they get to purchase or represent the property when you sell. Please … this is a recipe for disaster.

Clauses that limit the Property Manager’s Liability
The Property Manager is at ground level, performing the day-to-day actions of management and maintenance of the Property. They are fully responsible. Your Contract needs to make sure they hold the liability … NOT You.

What to Always Put Into Your Property Manager Contract:

30 Day notice to terminate the Contract
If you want to change Management Companies, you only need to give your current manager a 30 day notice.

Specific Performance Clauses
If you need to have the 10 fire damaged units in your Apartment Complex rehabbed and ready to rent in 90 days … put that in your Contract with your Property Manager. If they fail to meet this specific performance goal this becomes grounds to get out of your Contract.

Ideally you and your Property Manager jointly developed this Asset Management Plan, so getting them to agree to be held accountable should be relatively easy.

NOTE:
Even if you have one Property Management Company for your entire portfolio of Properties, make sure you have individual contracts for each property with Property specific performance clauses.

Remember, negotiations occur in all phases of your Commercial Property Investment … not just with the Seller. Make sure you negotiate a Property Management Contract that protects you and your Investors and makes it relatively easy to change Managers if they do not perform.

Any home inspector can tell you that most crawlspaces have moisture problems. There are two different types of crawlspace setups–vented and non-vented.

Vented crawlspaces have vents that allow for cross ventilation and the home?s sub floor is insulated along with the pipes in the crawlspace to prevent freezing. There?s a vapor barrier on the ground and vents are closed in the winter time. A small heater or heat tape may also be used to help keep the pipes from freezing in addition to insulation on the pipes.

With non-vented crawlspaces, foundation walls are insulated, but the sub-floor isn?t. The vents are blocked off with insulation all year long, and a vapor barrier is in place on the ground. Air is conditioned with a dehumidifier. A small heater and pipe insulation may still be used.

Problems arise when there are inadequate or no rain gutters. Did you know the average roof lets go of 1,000 gallons of water during 1 inch of rain? You can keep water from falling along the foundation and finding your crawlspace by using solid rain gutter covers to cover the gutter opening. This allows water to come in by curling under the cap. Unfortunately, mesh and screen covers get clogged up or collapse.

Do downspouts end along your foundation? They need to let water run 6 feet or more away from your home.

Does your terrain slope toward your foundation? Water must be directed away from the home because water can cause serious foundation damage.

Do you remember to open the vents when weather warms up? Your house needs to breathe. Low decks and shrubs can block vents and make them useless. Your home?s crawlspace needs a minimum of 1 square foot of ventilation for every 150 square feet of crawlspace floor area. Vents should be within 3 feet of the corners allowing for cross ventilation.

Could your insulation be installed upside down? You may have insulation in the flooring. The paper side of the fiberglass insulation should face the heated living space and be placed against the sub flooring. Otherwise it will trap moisture between the sub floor and the paper and hide moisture damage. A properly set up non-vented crawlspace won?t need insulation.

Is your moisture (vapor) barrier damaged or loose? It should be a 6 mil thick poly vapor barrier on your crawlspace ground and should be overlapped and sealed around columns and walls. This keeps ground moisture vapors from rising up into your framing.

If you have a sump pump installed, make sure it is at the lowest point in the crawlspace. All areas should easily drain to it. Inspect your pump regularly. Does it work automatically? It should be in a plastic cylinder in the ground and eject water outside, away from the building and not into the septic or sewer system.

If your crawlspace is non-vented, you must have a dehumidifier, and the collected water should be piped to a sump pump or condensate pump. If you don?t do this, you?ll have to dump water daily, and who wants to do that? Incidentally, buy a good quality dehumidifier with an adjustable, automatic setting so it does not run all the time.

Is your crawlspace kept neat, clean and accessible? Inspect it often for signs of moisture or mildew. Check with the local code official for any repairs you might need. Don?t underestimate the importance of your crawlspace and what you can do to prevent that all too common moisture damage.

What do teenagers and termites have in common? They?ll both eat you out of house and home. The difference is, termites do it literally by doing serious damage to wood structures.

Termites invite themselves into your home, but you may not know it. If they go unnoticed for a long time, they can cause tremendous damage. When your home inspector conducts his inspection, a home inspection engineer should thoroughly check for evidence of termites. Your mortgage lender may ask for a clear termite certificate.

If termites are discovered, an anti-termite chemical, or termiticide treatment, or a termite baiting system will be needed to get rid of them. A licensed professional engineer may then be necessary to design repair procedures for the damaged structures.

Though there are different types of termites, it?s the subterranean termites that make their home in the ground near a source of moisture, warmth, and wood. They send workers to find food for their colony, and they start in the lower parts of your home.

Food for ttermites is any source of cellulose, such as the wooden framing of your home, wooden flooring materials, and sub-flooring. They also like paper on sheetrock walls, newspapers, magazines and just about anything that contains cellulose.

Here are a few steps to lower the chances of termite infestation. Make sure there is no wood to earth contact of any parts of your home. Don?t allow landscape chips from flower beds to come in contact with your home?s siding. Keep gutters and their extensions clean so water can drain away from the building. This is a good idea for several other reasons as well, but don?t invite termites with a moist environment.

Some homes are at greater risk of termite problems. For example, slab on grade homes with radiant floor heating are a natural breeding ground for termites. If you own a home with radiant floor heating, a wise maintenance procedure is to periodically have inspections done by a competent and qualified exterminator.

Detecting termites is difficult because termites eat out the inside of wooden beans, leaving the outer shell. Signs of termite damage include the following:

* A termite swarm flying or crawling around your property

* Damaged wood, especially pulp or saw dust around the house or under wooden overhangs

* Termite shelter tubes?sand colored tubes about the thickness of a pencil

* Change in sounds, such as woodwork that sounds hollow when struck or you hear extra creaks in floors

The best time to inspect for termites is in the spring and fall of the year. Any inspection should thoroughly check the basement, crawl spaces, and upper floors as well.

If you?re planning to buy a home, you could find yourself in serious trouble by moving heavy furniture into an area where termites have damaged flooring. A home inspection can determine the extent of termite damage and whether major repairs or replacement is required for flooring or other structures.

The possibility of termite trouble is one more critical reason to have a home inspected before you either buy or sell.

Cutlery is mainly used in the western world for preparing, serving and eating food. It also goes by the name of flatware or silverware. Sometimes cutlery can specifically refer to knives or cutting tools. The main pieces of cutlery are the knife, spoon and fork. Some modern cutlery includes hybrid pieces such as the spork, spife and knork.

Cutlery has been made all over the world but much of the cutlery production was in Sheffield and Birmingham in the 16th century. The industry in Birmingham tended to make swords called long cutlers while those in Sheffield made knifes. Traditionally cutlery was made of silver but when new steelmaking methods were developed stainless steel began to be used for everyday cutlery.

The main piece of cutlery has always been the knife as it was not until the 14th century that the fork began to be used. Knives were first used by hunters and then they eventually made their way into the kitchen. Many of the older companies such as henckels was founded in 1731 and is known for their craftsmanship. Today traditional cutlery is on the same level as crystal glasses and porcelain, only to be used for special occasions.

When looking to purchase cutlery or tableware sets you need to remember some important tips. Many individuals will purchase the cutlery with the most knifes but you need to make sure you will use all of the knives. If you purchase a 21 piece knife set but then only use 3 of the knives then you have wasted quite a bit of money. Generally most individuals will use a slicing knife, bread knife, chef’s knife and a paring knife.

In the 1990s, the bean bag enjoyed a revival, and the range that is currently available is mind-boggling. Some companies exist that sell nothing but bean bags and their accessories. Now there are designs in different shapes and styles; a great variety of fabrics are used including vinyl, leather, cotton and polyester. They come in a huge range of colors and different sizes; there are fancy shapes like cars, animals and novelty shapes; there are bean bags for indoors, outdoors and even the pool. There are bean bags for one person, couches for two and even self-supporting models for extreme comfort.

Care and Use of Cutlery Knives

Isn’t cutlery knives? The answer is no, it is tools used for cooking, and the slicing of the food, and for used to eat. Today’s topic will be the care and use of cutlery knives. Is there a significant difference between knives? What knife do you use to slice and dice food? I will answer all of those questions and discuss the care and safety issues while using knives to prepare food.

Cutlery does not just refer to a knife it also refers to forks and spoons, as well as knives. There are a number of different knives that each are used for a specific purpose. Butter knives, for example, are used to spread butter on bread. Steak knives are used to cut through steak meat. A butcher knife would be used to cut through the larger cuts of meat.

There are a lot of different knives that we use in our daily food preparation. Knives with a short blade on them are used for peeling vegetables or a fruit like an apple. In looking at the blade of a butter knife, you will notice it has a very dull, non cutting blade. It is made for spreading different foods. Next you will see the ragged edge of the steak knife, it will cut through several types of meat including steak. It is important to know the purpose each of your knives.

Do you have a favorite knife that you use most every time you are making food for cooking? Then you know what you like as far as knives go. You can buy a knife for as little a five dollars, and the price can go all the way up to hundreds of dollars. There are specialty shops that sell the high end priced knives. It’s all about what you want to spend for a knife, and how much you use that knife. Just remember whatever knife that you choose, that you select the correct knife for what it is meant to be used for.

I can’t stress enough to be safe when using any knife. When you reach down to pick up a knife, grasp it by the handle, get careless can result in a cut hand or finger. Before you start to prepare your food, watch where your hand is in relation to the blade of the knife. Make it a habit to take just a moment to think about your hand and fingers.

Caring for you knives will make them last a long time. Start by washing and drying your knives by hand. By drying them well, they are less likely to start rusting. Let’s talk about storing your knives. One way is to wrap your knives using plastic sheathing to cover the blades. Then place them into a drawer.

Another idea to store your knives is by using a wood block built for specifically for knives. These are very popular, and the block can sit on your kitchen counter. If you use a wooden cutting board, or a hard plastic board, this is better for the blades of your knives. Using a marble or cutting board made of stone can and will dull the blades of your knives, and will eventually damage the blade.

To sum this up, caring for you knives will insure they last for several years. Each knife has its own job, and is used just for that purpose. Keep safety in mind while using knives for food preparation. You’ve learned how to store you knives properly.

Bean bag chairs used to only be available in vinyl and cloth, but today you get just about any fabric to match your d?cor so your chair will just blend in. Some of these chairs are available to purchase them with a separate outer cover to you can easily remove it and throw it in the washer to freshen it up.

A very important feature to a bean bag chair to consider is the zipper. Unless you buy a chair that has an outer and inner zipper then make sure the zipper locks closed, this way children can not open it and ingest the filling. Because of all the normal wear and tear your bean bag chair will endure due to daily sitting in and stretching you should choose a fabric that is high quality.

Bean bag chairs today come in a variety of shapes and sizes. The most commonly seen ones are smaller child friendly ones. These are ideal for children because they are smaller and able to withstand their smaller bodies. There is also a pear shaped one that is great for adults because of the added back support it boasts, and it is usually taller then other more rounder ones. There is also a pancake looking one that has many functions. It can be used as a love seat, ottoman, or a coffee table.

When you think of bean bag chairs you might assume they are filled with dried beans, while some beanbags might be; beanbag chairs are not. Usually beanbag chairs are filled with either a polystyrene fill or small chunks of Styrofoam.

While deciding which filling you want your bean bag chair filled with keep in mind that you need to choose a filling that can withstand all the wear and tear that will be put on it. You also need to think ahead in the future, see if the filling can be purchased separately to refill your bag as the filled compresses down. The best filling has to be polystyrene, because it is composed of a material that can withstand all the compressing of being sat on.

The bean bag chair may have been around a long time, but it sure has adapted to the current time and society. It has evolved from being a plain cushy chair to something anyone would be able to put in their room and have it fit in with any d?cor.

Do I Use a Realtor or Sell My Home Myself?

When it comes time for you to sell your home you have two options; you can hire a Realtor to do the selling for you or you can tackle the task of going ?For Sale by Owner, or FSBO.? Of course if you sell the home yourself then you will avoid the commission that is charged by a Realtor and that can equate to a good bit of money. But is it worth it? Either way you decide to go the point is to sell the home, so how do you decide what is right for you?

There are several factors that should be looked at before you decide whether or not you want to hire a Realtor or not. These factors include:

?Your time: If you plan on selling your home yourself then you need to be sure that you will have enough time to do so. Selling your home without a Realtor requires you to be at the ready in order to answer any and all questions regarding the home and be available to show the home at a moment?s notice. If your job and day allows you this freedom then you may want to consider a FSBO experience.

?Your knowledge: Selling a home is more than just agreeing with someone on price. There is a whole multitude of paperwork that must be filled out and filed as well as title searches and many other nuances involved with selling a home. If your knowledge of all of this is very minimal then it may be in your best interest to hire a professional. There is no point in trying to do it yourself and save if you are going got lose the sale due to your ignorance on the subject.

?How well you can qualify a buyer: This is a big one that many FSBO participants fail to realize. If you have a buyer that is not qualified but says that they are, your home could be tied up for several weeks before you realize what is going on. Realtors tend to pre-qualify buyers so that you know an offer on your home is a legitimate one and thus less time is wasted and the home is not tied up in a ?pending? mode which will discourage others from looking.

?The buyers: Believe it or not, there are many buyers out there that will only work with a Realtor. This is because they like the comfort of knowing that a professional is going to oversee the sale and handle all aspects of it in a timely and accurate fashion. Sometimes going with a Realtor will actually increase the number of hits you get on your home and that usually equates to more offers and more money in the end.

When it comes right down to it whether or not you decide to hire a Realtor is a personal choice, but it is one that should be considered greatly. If you have limited knowledge of the real estate industry and limited time, then you are better off just biting the commission bullet and hiring a pro to help you get the job done right.
